국유재산 관리 1. 의 의 ◦ “관리”란 국유재산의 취득 운용과 유지 보존을 위한 모든 행위 - 행정재산은 국가의 행정목적에 쓰이는 재산으로 본래 목적 외의 용도 사용 엄격히 제한 - 다만 행정목적 수행에 장애가 되지 않는 범위 내에서 사용허가는 가능 (법 제30조제1항) 2. 취 득 ◦ 국가가 소유권을 취득하는 행위로서 건물의 신·증축, 공작물 설치, 매수 공유수면 매립, 토지수용, 교환, 기부채납, 신탁재산 반환, 출자 등의 행위 - 사권이 설정된 재산은 그 사권이 소멸된 후가 아니면 국유재산으로 취득하지 못하며 판결에 따라 취득 가능 (법 제11조제1항) 3. 사용허가 및 대부 ◦ 사용허가 및 대부의 의미 - 사용허가 : 행정재산을 국가 외의 자에게 유무상으로 일정 기간 사용수익 허용하는 것 - 대부 : 일반재산을 국가 외의 자에게 유무상으로 일정 기간 사용수익 계약하는 것 ※ 행정재산의 임대를 “사용허가”라 하고 일반재산의 임대를 “대부”라 함 ◦ 사용허가 및 대부의 의의 - 행정재산은 그 용도에 장애가 되지 않는 범위 내에서 사용허가(법 제30조제1항) - 사용허가(대부) 받은 재산에는 건물 기타 영구시설물을 축조하지 못함 - 사용허가(대부) 받은 재산은 전대하지 못함 - 사용허가(대부) 기간 종료 또는 계약 취소, 철회 되어 재산 반환 시 원상회복 - 사용허가 중인 행정재산이 용도폐지 되어 총괄청에 인계될 경우 해당재산의 사용허가는 대부계약으로 전환된 것으로 봄(시행규칙 제14조제4항)

Definitions ◦ “Administration” refers to all acts of acquiring, managing, maintaining, and preserving State-owned properties - Administrative properties are properties used solely for the State’s administrative purposes, and other uses are firmly restricted - However, they may be used for other purposes to the extent that they do not hinder the intended administrative purpose (Article 30 (1) of the Act) 2. Acquisition ◦ This refers to cases in which a property comes into the State’s possession; examples include building construction, extension, installations, and purchases of structures, reclamation of water surfaces for official use, land expropriation, exchanges and donations, return of trust properties, investment, etc. - Properties upon which private rights have been established cannot be acquired as State-owned property unless the related private rights have expired or such property is acquired through a court decision (Article 11 (1) of the Act) 3. Permitted Use and Loan ◦ Definitions of “Permitted Use” and “Loan” - Permitted use: Allowing a non-State entity to use and profit from an administrative property with or without consideration for a certain period of time - Loan: Signing a contract with a non-State entity to use and profit from a general property with or without consideration for a certain period of time ※ Lease of an administrative property is called “permitted use” and the lease of a general property is called a “loan” ◦ Details of Permitted Use and Loan - Administrative properties may be used to the extent that they do not hinder their intended purposes of use (Article 30 (1) of the Act) - Buildings and other permanent facilities cannot be built on properties under permitted use or on loan - Properties under permitted use or on loan cannot be sublet - Properties must be restored to their original conditions prior to being returned at the end of the term of the permitted use or loan, or due to contract cancellation or withdrawal of permission thereof - If a property under permitted use is transferred to the supervising agency due to termination of its purpose of use, then it is deemed that the permission for use has been automatically converted into a loan contract (Article 14 (4) of the Enforcement Rule)
